The Hiring Our Heroes Drawing (“Drawing”) is being sponsored by Hiring Our Heroes, a program of the U.S. Chamber of Commerce Foundation, a 501(c)(3) charitable organization, with offices at 1615 H Street NW, Washington, DC 20002 (“Sponsor”).
ELIGIBILITY: Entrants must be individuals who (a) are legal residents of and currently reside in the contiguous United States; (b) are serving or have served in the active duty, National Guard or Reserve components of the Army, Navy, Marine Corps, Air Force, or Coast Guard and, if discharged or released, have an honorable discharge or are currently married to a current member of the Army, Navy, Marine Corps, Air Force, or Coast Guard or their National Guard or Reserve components; (c) have a valid driver’s license and, if selected as the Winner, be able to provide proof of insurance for the selected vehicle; (e) agree to be bound by the terms and conditions of these official rules; and (e) be 18 years of age or older as of date of entry (“Entrant”). Proof of eligibility, including proof of military service, may be required before Entrant can be declared the Winner of the Drawing. Employees of Sponsor and Administrator and any other organizations affiliated with the Drawing and each of their respective parents, agents, affiliates, subsidiaries and advertising and promotion agencies, and members of their immediate family (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win the Drawing.
ENTRY PROCESS: Entrants will be allowed to register on an online portal managed by Sponsor at hiringourheroes.org (“Entry”). One Entry allowed per Entrant. Entry must include Entrant’s full name, zip code, phone number, email address and age. Only fully completed Entries will be allowed. Entries cannot be returned and become the sole property of Sponsor. By Entering this Drawing, Entrant accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding all respects. Any attempt to obtain or submit more than one Entry by using multiple/different email addresses or any other methods will void Entry and Entrant may be disqualified at the sole discretion of Sponsor. All Entries must be made by an eligible Entrant. No automatic Entries permitted.
DRAWING PERIOD: The Drawing starts at 12:01 a.m. Eastern Standard Time (“EST”) On July 1, 2023 and ends at 11:59 p.m. EST on December 1, 2023 (“Drawing Period”). All Entries must be received by 11:59 p.m. EST on December 1, 2023. Odds of winning are dependent on the number of eligible Entries received. One winner will be randomly drawn under the supervision of Sponsor on or about December 7, 2023 from among all eligible Entries received during the Drawing Period for receipt of one Prize Vehicle, as defined below (potential “Winner”). The odds of winning will vary depending on the number of eligible Entries received. Winner will be notified on or about December 14, 2023, by phone or email at the phone number or email address provided in the Entry after the random drawing. Winner must respond fully and accurately to Sponsor’s notification within 24 hours from time of notification, providing any proof of eligibility required by the Sponsor, in order to claim the Prize Vehicle, as detailed below, and must meet all other eligibility requirements in order to be declared the Winner. Sponsor shall not be responsible for any delay or failure to receive notification for any reason, including but not limited to inactive email account, technical difficulties or the failure to actively monitor any email account by Entrant. In the event of a dispute as to the identity of a Winner and his/her email address, as provided on Entry, the Winner will be declared as the account holder of the email address submitted on Entry. The winner may be required to provide proof of eligibility and return an executed affidavit of eligibility, release of liability, publicity release by a date certain and information for completion of a 1099 US tax form. Any Winner notification not properly answered or met or returned as undeliverable may result in forfeiture of Prize Vehicle, as detailed below, and an alternate Winner will be randomly selected by Sponsor.
Prize Vehicle: One Prize Vehicle will be provided to one Winner, as follows: one current year Toyota vehicle with a Manufacturer’s Suggested Retail Price (“MSRP”) of $40,915.00 or less (includes delivery, processing & handling fee of $955 and excludes taxes, title, license, and registration) (“Prize Vehicle”). Selection of Prize Vehicle shall be at Sponsor’s sole discretion and must be selected from existing inventory at the dealership as determined by sponsor based on the Entrant’s zip code at time of Entry. All taxes, license, registration, and any other applicable fees of any type related to receipt or use of Prize Vehicle shall be born solely by Winner. Winner must claim Prize Vehicle at dealership as determined by Sponsor no later than March 1, 2024. No transfer of Prize Vehicle is permitted. Prize Vehicle cannot be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of Prize Vehicle. Sponsor will not replace any lost or stolen Prize Vehicle. Prize Vehicle is awarded “as is” with no warranty or guarantee, either express or implied, other than any manufacturer’s warranty that covers Prize Vehicle.
The depiction of the Prize Vehicle in any advertising or promotional materials may not reflect the actual Prize Vehicle delivered to the Winner. Sponsor will determine all features of Prize Vehicle, including, but not limited to, color of exterior and interior, and all other features or upgrades will be allowed only if permitted by delivery dealer and paid for by Winner. Winner must be a U.S. licensed driver and will be required to provide proof of valid U.S. driver’s license and legally-required insurance at time of delivery (or an alternative Winner shall be selected if applicable and the original Winner’s rights to the Prize Vehicle shall be automatically forfeited). Winner is responsible for title, applicable taxes, license, registration, dealer preparation costs, auto insurance and other fees associated with Prize Vehicle. Sponsor shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with the Prize Vehicle provided pursuant to the Drawing and/or any person’s participation in the Drawing; provided, however, that Toyota Motor Sales, U.S.A., Inc. (“TMS”) shall be solely responsible for any express-written limited warranties specifically set forth in the applicable Owner’s Guide for the Prize Vehicle. Winner must take delivery of Prize Vehicle from the automobile dealership designated by Sponsor. Sponsor shall not be responsible for delays in delivery of the Prize Vehicle, and delivery is subject to availability. Sponsor, however, shall use all reasonable efforts, subject to availability, to deliver the Prize Vehicle within one hundred twenty (120) days of completion of verification process. Winner shall bear all risk of loss or damage to the Prize Vehicle after it has been delivered to the specified delivery site. Winner must personally retrieve the Prize Vehicle within thirty (30) days of written notification of delivery. Prize Vehicle is non-transferable and no substitution or cash equivalent is allowed except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the Prize Vehicle for one of comparable or greater value, at its sole discretion. Winner is responsible for all taxes and other costs and fees associated with Prize Vehicle receipt and/or use not specified herein as being awarded. Odds of winning the Prize Vehicle depend on the number of eligible Entries received during the Drawing Period.
GENERAL RULES: The decisions of Sponsor are final with respect to all matters relating to this Drawing, and participants agree to be bound by these Official Rules. No transfer of Prize Vehicle permitted. Prize Vehicle cannot be awarded in cash. In no event will Sponsor be liable for more than the stated retail value of the Prize Vehicle. Participation in the Drawing constitutes permission to use Entrant’s name, likeness, voice, address (city and state), and statements and/or testimonials in all media, now or hereafter known, throughout the world in perpetuity, in any manner Sponsor deems appropriate without any further compensation or notification to or permission of the respective Entrant, unless prohibited by applicable law. A written agreement of eligibility and right of publicity and IRS forms may be required to be signed by Entrant before award of the Prize Vehicle.
RELEASE: By Entering the Drawing all Entrants, including the Winner, agree to release and hold harmless Sponsor, Administrator, Drawing partners and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and Prize Vehicle suppliers and each of their respective parent companies and each such companies’ officers, directors, employees and agents, and the U.S. Chamber of Commerce Foundation’s Hiring Our Heroes program, and its affiliates, directors, employees, agents, and other partners (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death or damage to or loss of property, in whole or in part, directly or indirectly, arising out of participation in the Drawing, receipt, use or misuse of Prize Vehicle.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Drawing or by any other errors; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Drawing; (4) technical or human error which may occur in the administration of the Drawing or the processing of Entries; (5) late, lost, undeliverable, damaged or stolen mail or misdirected email; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt, use or misuse of Prize Vehicle. If for any reason the Drawing is not capable of running as contemplated in these Official Rules, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Drawing in whole or in part without any liability to any Entrant.
DISPUTES: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Drawing or receipt or use of Prize Vehicle shall be resolved individually, without resort to any form of class action, and exclusively by arbitration; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with Entering this Drawing, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages including attorney’s fees, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Drawing, shall be governed by, and construed in accordance with, the laws of District of Columbia without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than District of Columbia.
PRIVACY: Any personal information supplied by Entrant will be subject to the privacy policy of Sponsor posted at https://hiringourheroes.org/privacy-policy/.
